Your calls and texts leave on a carrier registration held by EString Software Corporation and shared with our
other customers. A complaint about your traffic can suspend messaging for all of them. This policy
is what we enforce to stop that happening, and we enforce it immediately.
Consent
Text only people who have given you prior express consent to be texted at that
number.
For marketing or promotional texts, you need prior express written consent
obtained before the message is sent, with a clear disclosure of what they are signing up for.
Consent is not transferable. You may not buy, rent, or scrape phone numbers and text them, and
you may not rely on consent someone gave to a different business.
Keep records of consent. If a complaint reaches us, we will ask you for them.
Opt-outs and identification
Stop immediately on STOP, UNSUBSCRIBE, CANCEL, END, QUIT, or any clear request to stop —
however it is phrased, and including requests made on a call.
Reply to HELP with a message that identifies who you are and how to reach you.
Identify yourself in the first message of any new conversation with someone who may not
recognize the number.
Do not re-add someone who has opted out, in any campaign, from any of your numbers.
Timing
No marketing calls or texts before 8:00am or after 9:00pm in the recipient's local
time, and none at all to numbers on the National Do Not Call Registry or on your own internal
do-not-call list without an applicable exemption.
Content that is never permitted
Regardless of consent, the following may not be sent through AI 2nd Line:
SHAFT: sexual or adult content, hate speech, alcohol, firearms or ammunition,
tobacco, vaping or nicotine.
Controlled or restricted substances: cannabis, CBD, kratom, illegal drugs, or
prescription medication offers — including where legal in the sending or receiving state, because
the carriers prohibit them nationally.
High-risk financial: payday, short-term or high-interest loans, debt
collection, debt relief or consolidation, credit repair, student loan servicing, tax relief,
cryptocurrency promotion, and investment or get-rich-quick offers.
Lead generation and affiliate marketing: messages promoting a third party's
goods or services, affiliate links, or any arrangement where the recipient's details were obtained
from a lead seller or shared onward.
Gambling and sweepstakes, contests or lotteries.
Deception and abuse: phishing, fraud, impersonation of a person, business or
government body, malware, deceptive subject matter, harassment, threats, stalking, or any content
unlawful in the recipient's jurisdiction.
Practices that are never permitted
Evading filters: rotating numbers, spreading the same campaign across multiple
numbers ("snowshoeing"), obfuscating words, or any technique whose purpose is to avoid carrier
filtering.
Public URL shorteners (bit.ly, tinyurl and similar). They are widely blocked;
use a link on a domain you control.
Caller ID spoofing, including displaying a number you do not control or
"neighbor spoofing" to match the recipient's area code.
Bulk unsolicited sending of any kind, and automated calling to lists without
the consent the law requires.
Misrepresenting your use case to us or to the carriers, or using the service
for a purpose materially different from the one registered.
Using the AI assistant
Do not instruct the assistant to deny being an AI if asked directly.
Do not configure it to impersonate a specific real person or organization, or to use a voice
cloned from a real person without that person's documented permission.
Where your jurisdiction requires a bot or AI disclosure, configure the assistant to give it.
If you disable the call-recording announcement, lawful recording in every jurisdiction you call
becomes your responsibility.
The Agent API
Everything sent with your API key is your traffic and your responsibility, including traffic
sent by software you did not write.
Do not share, publish or embed your key. Revoke it in the app the moment you suspect
exposure.
Do not use the key to send on behalf of third parties, or to run a messaging or calling service
for other people, without our prior written agreement.
Give your agents a stated objective and a way to stop. An agent that retries a failing call in
a loop is indistinguishable from an attack at the carrier level.
How we enforce this
We monitor delivery failures, opt-out rates, complaint signals and carrier notices. Where we
believe traffic breaches this policy or endangers the registration, we may — without prior
notice — throttle or block messages, suspend a number, revoke an API key, or terminate the account.
Where a carrier or regulator charges us a fee or penalty attributable to your traffic, you are
responsible for it under section 11 of the Terms of Service.
If you believe an enforcement action was a mistake, use the contact form and we will look at it.
